If the company requires an employee to participate in mental health counseling to keep employment, is the company responsible for the co-pay?

It would be an ADA violation to require mental health treatment as a condition of employment.

Which is what I have shared and advised my leadership.  Thanks so much.  Maybe with the number of responses I have gotten, I have made some enrodes.

There are also state laws to consider. However, making a mandatory referral to an EAP is within the Er's right, I think.
Then, the issues become - and always remain - job performance and reasonable accommodation.
