The American Immigration Lawyers Association (AILA) recently sent out a request for examples of recent PERM denials. The request cites specific denial reasons and in turn offers insight into some problem areas right now with PERM filings. The specific denial reasons in the request include: * PERM denials (post-audit) based on insufficient evidence of Business Necessity. * PERM denials (without audit) based on employer not responding to DOL verification phone calls where DOL sent the email confirmation after the employer responded to the post-filing questionnaire. * PERM denials based on pre-filing recruitment after case is ordered into Supervised Recruitment. * PERM denials based on lack of substantial equivalency of alternative minimum job requirements.
